Cornwall PAT Testing Services

General Conditions of supply and installation

1. Unless otherwise agreed in writing by Cornwall Pat Testing / Devon PAT Testing these conditions which supersede any earlier sets of conditions appearing in Cornwall Pat Testing / Devon PAT Testing’s catalogues or elsewhere shall override any terms or conditions stipulated, incorporated or referred to by the customer whether in the order or in any negotiations not withstanding any stipulation to the contrary.

Quotations

2. No quotations given by Cornwall Pat Testing / Devon PAT Testing for the supply of goods or for the supply of services shall constitute an offer, and Cornwall Pat Testing / Devon PAT Testing hereby reserves the absolute right to withdraw and amend any such quotation until such time as Cornwall Pat Testing / Devon PAT Testing has accepted the order of the customer. All quotations are valid for 30 days only.

Orders

3. All orders shall be in writing and shall give sufficient details to enable Cornwall Pat Testing / Devon PAT Testing to identify any relevant quotation, and in particular quote all reference numbers. Any special requirements of the customer must be clearly indicated. Acceptance of any order or of any variation of an order which may be made by
telephone, fax, and telex will be conditional upon its being confirmed in writing by the customer within seven days.

Specifications

4. Cornwall Pat Testing / Devon PAT Testing hereby reserves the right to substitute the goods of one manufacturer for goods of another but of the same fitness quality and specification, notwithstanding that the goods of one manufacturer only are quoted in the accepted order.

Liability

5. Cornwall Pat Testing / Devon PAT Testing shall not be liable for any personal injury or death, however caused, arising from the supply of goods or services except where such injury or death is shown to result from the negligence of Cornwall Pat Testing / Devon PAT Testing or its employees or agents.
6. Save as provided in numbered paragraphs 7 and 8 below, Cornwall Pat Testing / Devon PAT Testing shall not be liable for any damage, injury or loss of any kind whatsoever to the property of any person, howsoever caused, arising during or out of the supply of services or the supply or installation of goods by Cornwall Pat Testing / Devon PAT Testing.
7. Cornwall Pat Testing / Devon PAT Testing shall not be liable for any defects in workmanship, for any delay or for any other shortcomings in the services supplied by Cornwall Pat Testing / Devon PAT Testing to the customer except, in the case of defects in workmanship only, if it is shown that such defects were the direct result of negligence on the part of Cornwall Pat Testing / Devon PAT Testing. In any event, the liability of Cornwall Pat Testing / Devon PAT Testing shall not exceed the cost of remedying the defects in workmanship and Cornwall Pat Testing / Devon PAT Testing shall not be liable for any loss consequent upon such defects.
8. (a) In relation to any goods supplied to the customer Cornwall Pat Testing / Devon PAT Testing gives no warranties and is bound by no conditions, whether as to the quality, fitness, description or specification or otherwise howsoever save so far as such warranties are implied by statute may not be excluded.
(b) The customer shall notify Cornwall Pat Testing / Devon PAT Testing forthwith in writing upon the discovery of any defect in any goods supplied to the customer.
(c) The maximum liability of Cornwall Pat Testing / Devon PAT Testing (including liability for works necessary to replace any other consequential loss) in respect of any breach of any warranty or condition shall not exceed one and a half times the price (at the date of acceptance of the customer’s order) of the defective item.
(d) Provided the customer shall have notified Cornwall Pat Testing / Devon PAT Testing as required by sub-paragraph (b) above, Cornwall Pat Testing / Devon PAT Testing will at the request and cost of the customer pass on to the customer the benefit of the guarantee (if any) which Cornwall Pat Testing / Devon PAT Testing may have received from the supplier of the goods in question.
9. Any statements, oral or written, made prior to the acceptance of the customer’s order as to the specification or performance of any equipment, any savings of energy likely to result from any installation and the time within which any installation may be completed, are to be regarded as estimates only and do not form part of any contract between Cornwall Pat Testing / Devon PAT Testing and the customer.

PAT Testing Service


11. All pat testing work will be carried out according to the Institute of Electrical Engineers (IEE) Code of Practice for In-Service Inspection and Testing of Electrical Equipment. Because the IEE code of practice for In-Service Inspection and Testing of Electrical Equipment does not deal with the legislation relating to the supply of equipment whether new or second-hand, to a third party by way of sale or other method Cornwall Pat Testing / Devon PAT Testing will not test any equipment which is intended for supply to a third party. Any equipment made available for supply at any time after being tested by Cornwall Pat Testing / Devon PAT Testing will null and void the test results.
12. A competent person shall be provided by the customer to meet our technician, to advise on any health and safety issues when working at the customer’s premises and also to ensure the availability of appliances for pat testing.
13. Cornwall Pat Testing / Devon PAT Testing accepts no liability for injury, loss or damage for appliances that are not made available or are inaccessible during the agreed pat test/inspection period. Cornwall Pat Testing / Devon PAT Testing accepts no liability for injury, loss or damage for appliances that are found to be faulty before or after pat testing.
14.(a)The customer shall ensure that any critical information or data has been protected/backed up prior to the start of inspection and testing.
All pat testing is carried out solely at the appliance owner’s risk. The competent person will advise our technician of any key systems and or appliances that should not be disconected from the mains power supply.
(b)On completion of the testing process, the competent person should ensure that all appliances, servers, data systems or other key or critical components, appliances or systems are functioning properly.
15. These conditions shall be subject to and construed in accordance with the laws of England.
